This policy sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us. 

Our Online Platform, App, Services and Websites are compliant with all applicable UK data protection legislation including the UK General Data Protection Regulation, the Data Protection Act 2018, and the Privacy and the Privacy and Electronic Communications Regulations 2003.

Our Online Platform, App, Services and Websites are not intended for children (under the age of 18) and we do not knowingly collect data relating to children. Where you access the Online Platform or App directly from us or visit our Websites we are the controller and are responsible for your personal data. 

The Online Platform or App may be commissioned by your healthcare provider, in which case they will be the controller, and we may be a processor. In this case, we only process your personal data in accordance with your healthcare provider’s instructions, we will have arrangements in place with them to keep your data safe, and you should ask them for details about how your personal data is used.

We have appointed a Data Protection Officer (DPO) and Clinical Safety Officer (CSO). If you have any questions about this Privacy Policy or the Online Platform, App or Services in general, please contact them using the details set out below.

We keep our Privacy Policy under regular review.

This version was last updated on10 August 2025. It may change and, if it does, these changes will be posted on our Online Platform, App or Websites and, where appropriate, notified to you. The new policy may be displayed on-screen and you may be required to read and accept the changes to continue your use of the Online Platform, App or Services.

THE DATA WE COLLECT ABOUT YOU

We may collect, use, store and transfer different kinds of personal data about you as follows:

  • Health Data: health records and any other information concerning your health.
  • Identity Data: first name, last name, maiden name, username or similar identifier, marital status, title, date of birth, gender.
  • Contact Data: address, telephone number, email address, emergency contact information.
  • Financial Data: bank account and payment card details.
  • Transaction Data: includes details of purchases and payments to and from you.
  • Device Data: type of device you use, device identifier (for example IMEI number, mobile phone number, MAC address, IP address, network information, mobile operating system, browser, time zone setting.
  • Content Data: includes information stored on your device including health data, friends lists, login information, photos, videos or other digital content.
  • Profile Data: includes your username and password, purchase history, your interests, preferences, feedback and survey responses.
  • Usage Data: includes detail of your use of our Online Platform, App or Services or your visits to any of our Websites including but not limited to traffic data and other communication data whether this is required for our own billing purposes or otherwise and the resources that you access. 
  • Marketing and Communications Data: includes your preferences in receiving marketing from us or third parties and your communication preferences.
  • Location Data: information regarding your or your device’s current location.

We also collect and create, and may use and share, Aggregated Data such as statistical or demographic data, for any purpose. Aggregated Data could be derived from your personal data but it not considered personal data in law as this data will not directly or indirectly reveal your identity. For example, we may aggregate your Usage Data to calculate the percentage of users accessing a specific Online Platform and App feature. However, if we combine or connect Aggregated Data with your personal data so that we can directly or indirectly identify you, we treat the combined data as personal data which will be used in accordance with Privacy Policy.

Your Health Data

Where you are an individual user, you and your healthcare professional can use the Online Platform, App and Services to upload and share your personal data including data concerning your health and other special categories of data contained within your health records.

Other Information You Give Us

This is information about you (including Identity, Contact, Financial and other Marketing and Communications data) you give us by filling in forms through our Online Platform, App, Services or Websites, or by corresponding with us (for example, by email, telephone, or chat). It includes information you provide when your register to use our Online Platform or App, access our Online Platform, App, Services or Websites, subscribe to any of our Services, share data via social media functions, and when you report a problem with our Online Platform, App, Services or Websites. If you contact us, we will keep record of that correspondence.

Information We Collect About You and Your Device 

Each time you visit one of our Websites or use our Online Platform or App, we will automatically collect personal data including Device, Content and Usage Data. We collect this data using cookies and other similar technologies (see below).

HOW WE USE YOUR PERSONAL DATA

We will only use your personal data when data protection law allows us to do so.

We will only send you direct marketing communications by email or text, ortext or share your personal data with any third party for marketing purposes, if we have your consent do so. You do not need to provide consent for marketing to access our Online Platform, App, Services or Websites. You have the right to withdraw that consent at any time by contacting us.

Should we intend to use your personal data for a new purpose, or on a different lawful basis, to those listed above, before doing so we will inform you and provide you with further information and, where appropriate, seek your consent.

DISCLOSURE OF YOUR PERSONAL DATA

When may share your personal data with the third parties set out below in connection with the purposes set out in the table above.

  • Where you are an individual user, your healthcare professional, as nominated by you (you are responsible for authorising and controlling which healthcare professionals have access to your data through our Online Platform, App and Services).
  • Where you are an individual user, any other person you wish to share your data with or give proxy or delegated access to your data, as nominated by you (you are responsible for authorising and controlling which people have access to your data through the Online Platform, App and Services).
  • Service providers acting as processors based in the UK who provide data hosting, IT and system administration services.
  • Professional advisers including lawyers, bankers, auditors and insurers based in the UK who provide consultancy, banking, legal, insurance and accounting services.
  • HM Revenue and Customs, regulators and other authorities based in the UK who require reporting of processing activities in certain circumstances.
  • Third parties to whom we may choose to sell, transfer or merge parts of our business or our assets. Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then the new owners may use your personal data in the same way as set out in this Privacy Policy.
  • Third parties to whom we are otherwise required by law to share personal data (e.g. in accordance with a court order).

INTERNATIONAL TRANSFERS

We do not transfer your personal data outside the UK.

DATA SECURITY

All information you provide to us via your device is encrypted and stored on secure Amazon Web Services (AWS) servers. Any payment transactions will be encrypted. We use recognised secure data storage technologies and online video consultation use secure encryption methods.

Where we have given you (or where you have chosen) a password that enables you to access certain parts of our Online Platform, App and Services, you are responsible for keeping this password confidential. We ask you not share your password with anyone.

Once we have received your information, we will use strict procedures and security features to try and prevent your personal data from being accidentally lost, used or accessed in an unauthorised way.

Certain Services may include social networking, chat room and forum features. Ensure when using these features that you do not submit any personal data that you do not want to be seen, collected or used by other users.

We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator when we are legally required to do so.

DATA RETENTION

We will retain your personal data only for as long as it is necessary for the purposes set out in this Privacy Policy. 

Details of retention periods for different aspects of your personal data are available in our Data Retention Policy which you can request by contacting us.

We will retain and use your personal data to the extent necessary to comply with our legal and regulatory obligation, co-operate with regulators or resolve disputes and legal claims. By law, we have to keep basic information on our customers (including Contact, Identify, Financial and Transaction Data) for 6 years after they cease being customers for tax purposes.

In some circumstances we will anonymise your personal data (so that it can no longer be associated with you) for research or statistical purposes, including by creating Aggregated Data, in which case we may use this information indefinitely without further notice to you.

In the event that you do not use the Online Platform, the App or Services for a period of 10 years then we will treat the account as expired, and your personal data may be deleted.

Under certain circumstances your have the following rights under data protection laws in relation to your personal data:

  • Request access to your personal data (commonly known as ‘data subject access request’). This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it.
  • Request correction of the personal data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need verify the accuracy of the new data you provide to us.
  • Request erasure of your personal data. This enables you to ask us to delete or remove personal data where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal data where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your personal data to comply with the law. We may not always be required to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.
  • Object to processing of your personal data where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms. You also have the right to object where we are processing your personal data for direct marketing purposes. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms.
  • Request restriction of processing of your personal data. This enables you to ask us to suspend the processing of your personal data in the following scenarios:
    • If you want us to establish the data’s accuracy.
    • Where our use of the data is unlawful but you do not want us to erase it.
    • Where you need us to hold the data even if we no longer require it as you need it to establish, exercise or defend legal claims.
    • You have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to use it.
  • Request transfer of your personal data to you or to a third party. We will provide to you, or the third party you have chosen, your personal data in a structured, commonly used, machine-readable format. Note that this right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you.
  • Withdraw consent at any time where we are relying on consent to process your personal data. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products or services to you. We will advise you if this is the case at the time you withdraw your consent. 
  • Not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you. We do not undertake such decision-making.

You can exercise any of these rights at any time by contacting us at help@evitas.co.uk.We will respond to your request without undue delay and in any event within one month of receipt of the request. Where necessary, taking into account the complexity and number of your requests, we may extend this period by two further months, in which case we will let you know.
